Terms of Service

1. Acceptance of Terms

By accessing or using Posti AI, you confirm that:

• You are at least 13 years of age
• If you are under 18, you have obtained parental or guardian consent
• You have the legal capacity to enter into a binding agreement
• You are not prohibited from using the Service under applicable laws

2. Description of Service

Posti AI is an AI-powered content generation application that helps users create social media content including carousels (5–7 slides), text posts, Instagram Reels scripts, attention hooks, and threads. The Service also includes voice input (speech-to-text), content management (save, edit, organize), and optional AI personalization with your explicit consent.

3. Account Registration

You must sign in using Apple Sign In to access the Service. You agree to provide accurate information, maintain the security of your account, notify us immediately of any unauthorized access, and accept responsibility for all activities under your account.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent or illegal activities, abuse the Service, or fail to pay subscription fees.

4. Subscription and Payments

Posti AI offers a free tier with 5 content generations and basic content types. Premium subscription ("Posti AI Premium") includes unlimited generations, all content types, personalized content features, and priority support.

• Price: approximately $20 USD per month (may vary by region)
• Free trial: 3-day free trial for new subscribers
• Billing: recurring monthly through Apple App Store
• Auto-renewal: subscriptions renew unless cancelled at least 24 hours before the end of the current period
• Cancellation: cancel anytime via Apple ID account settings; takes effect at end of current billing period
• Refunds: handled by Apple according to their refund policies

5. Content Ownership

You retain full ownership of:

• Content you input into the Service
• Content generated by AI based on your inputs
• Any modifications you make to generated content

By using Posti AI, you grant us a limited, non-exclusive, royalty-free license to process your content to provide the Service, use anonymized data to improve the Service, and feature your content for marketing (only with your explicit consent). Our intellectual property (design, features, technology) is protected by law and may not be copied, modified, reverse-engineered, or used to create derivative works.

6. AI-Generated Content Disclaimer

Content generated by Posti AI uses artificial intelligence (OpenAI technology). You acknowledge that AI may produce inaccurate information, unexpected results, and has limitations regarding context, nuance, and recent events.

You are solely responsible for reviewing and editing generated content, verifying accuracy of facts, ensuring compliance with platform guidelines, and any consequences of publishing AI-generated content. We do not guarantee that AI-generated content will be accurate, complete, suitable for any particular purpose, or free from third-party rights infringement.

7. Acceptable Use

You may use Posti AI for personal social media, business, and educational purposes. You may NOT:

• Generate illegal, harmful, hateful, or offensive content
• Create content that infringes intellectual property rights
• Produce spam, misleading, or deceptive content
• Harass, abuse, or harm others
• Circumvent usage limits, rate limits, or security measures
• Reverse-engineer, exploit, or redistribute the Service
• Impersonate any person or entity
• Generate content that violates OpenAI's usage policies

Content moderation is enforced via OpenAI's systems. Violating content may be blocked, flagged, or result in account suspension.

8. Third-Party Services

Posti AI integrates with the following third-party services:

• Apple — Sign In and App Store payments (subject to Apple ToS)
• OpenAI — AI content generation (subject to OpenAI Usage Policies; OpenAI does not store your API content)
• RevenueCat — Subscription management (subject to RevenueCat ToS)
• Appwrite — Data storage hosted in Germany, EU (subject to Appwrite ToS)

9. Limitation of Liability

Posti AI is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, revenue, or data, business interruption, or damages arising from use of AI-generated content. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim. Some jurisdictions do not allow limitation of certain warranties; in such cases, our liability is limited to the maximum extent permitted by law.

10. Termination

You may stop using the Service at any time by deleting your account, uninstalling the app, or cancelling your subscription. We may terminate or suspend your access immediately for breach of Terms, fraudulent or illegal activity, non-payment, or extended inactivity. Upon termination, your right to use the Service ceases immediately, your data will be deleted, and any outstanding fees remain payable.

11. Governing Law

These Terms are governed by the laws of Ukraine. Disputes shall first be attempted to be resolved through good-faith negotiation; if unresolved, submitted to the courts of Lviv, Ukraine. You agree to resolve disputes individually and waive the right to participate in class actions.

12. Apple-Specific Terms

As required by Apple App Store:

• These Terms are between you and Nazar Verhun, not Apple
• Apple has no obligation to provide maintenance or support for Posti AI
• Apple is not responsible for any product warranties
• Apple is not responsible for any claims related to Posti AI
• Apple is a third-party beneficiary of these Terms

13. Changes to Terms

We may modify these Terms at any time. Changes will be posted on this page and in the app, effective immediately. We will notify you via email or in-app notification for material changes. Continued use of Posti AI after changes constitutes acceptance of the revised Terms.
